You can use your eb3 EAD.
But first to get into EB2 category, you have to first file another separate labor with a different employer (w/same employer it will most likely rejected) and then file 140 separately agian and then once your 140 is approved get it interfiled and then port from eb3 to eb2.

There will be a great chance that my parent company will close down my current company after I'm transferred to them. I don't think my current employee will withdraw my I-140 case in the future. Hopefully that I-140 will go thru so I can use its PD for my future PERM/I-140 application.

If one had done his/ her bachelors and worked for 5 yrs and did Masters (online) and worked for 4 years after Masters, can he/she claim Masters with 9 yrs of exp?? Pls clarify.

Hi,
I just saw on DOL website that my PBEC labor has been approved, on the other hand my old i-140 is stuck in NSC filed Sept 9th, 2006 EB3.
My question is how can i port my old PD? Should i wait for the old i-140 to be approved and then file for the new one or is there a way i can use the old i-140 later on during the 485 filing time to port the PD?
Any suggestion will be appreciated.

I planning to use AC 21 from Next week, I plan to call my parents in July 2008, What should I mention as my Immigration Status in Invitation letter.
As I will not be on H1B and neither I have Green Card ?
I talked to lot of people about using AC21, nobody is clear.
Since you confirmly mentioned that you'll invoke AC21 next week, could you inform us as you proceed further in this process. Please remember you are helping the whole community.

It is a case to sign in native language...
Well, if you forgot to fill the native language thing but signed the form, you don't have to worry about anything. Although the form is incomplete, the officer has no way of knowing for sure that your native alphabet is other than English... You may or may not get an RFE on this later...

Currently on H4 and validity expires on 09/23/2010. Can be applied for extension when principal applicants H1B is being extended(from his company), but since I have my H1B case filed with USCIS, will it create any conflict if I apply for H4 extension now? (ideally for 7 days (23rd sept to 30th sept) !! 'coz if approved, H1B status becomes valid from Oct 1st, right? )
Also, is there any rule which states that, when a case is pending with USCIS, legally you are not supposed to leave the country?

Hello,
So let's say my PD is current and my processing date is current as well. The USCIS starts looking at my 485. While they're working on it, the PD retrogresses. Would they drop my application since my PD is no longer current or would it still continue to be processed since I've crossed the PD-current hurdle previously?

I am an F1 visa student and am marrying my sweetheart who is an American citizen. We are planning to pick up the marriage license tomorrow, in MA. I know one of the questions is "residence". Do I put my local residence (I've been here for about 6 years) or my foreign residence? I do not want to jeopardize my status.

since u'r a student in legal status & u live in US for last 6 yr..... so u've to have a US address..... i think it will be best to put US address..... it will keep things simple..... there is nothing wrong with u having a US address.... becoz u live here......

I'm also in the same situation. My attorney says wait till USCIS figures out that there are duplicates and sends a notice to withdraw one of the petitions. Of course, the checks would be en-cashed for both the petitions.

I think: We donot have a choice. We have to show up on the day and time given on FP notice. If we can't- we have to request uscis for re-scheduling.
Call the ASC office and usually in such circumstances.. they allow to come earlier... Lots of ASCs are open sat.. So that may be good for you... Call your local ASC...

No. No. No. No. Your spouse can do anything with that EAD. Your spouse can do multiple jobs but once your spouse starts using EAD spouse's H-1 gets void.Me and my spouse both work on H1B and I am applying for I-485 along with EAD/AP for both me and my spouse. My question is since my spouse is already in H1B with certain job title which was mentioned in one of the documents that was filled with i-485, when spouse uses EAD does she need to be looking for similiar jobs only?. Please clarify. Thanks in advance.

I am not exactly in this scenario.
In my case I moved to a different company that already revalidated my H1B before moving to the new company.
So when they old company H1B is revoked, I say an LUD on the new company H1B. But there is no EVL RFE. And there is no soft LUD also on my I-485.

I am an Indian national currently in the AOS-pending state. My wife & I are looking to adopt a child either from India/US or a different country. From what I have found out, this seems to be a herculean task. Is this even possible? Has anyone successfully completed this process, or know of the details/steps involved. I understand that a H1B visa is the expense to the employer and is not a taxable benefit to the employee. If a company wishes to pay for the green card for the employee, granting them permanent residence in the U.S., is this a taxable benefit to the employee? Should it be added to their W-2? If yes, where is the IRS documentation on this? I can�t find it. Thanks.
